By scheduling an appointment or using our services, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
Service
Your vehicle must be in safe working condition and suitable for undercoating and restoration services. New Frank Auto Restoration LLC is not responsible for issues arising from pre-existing mechanical problems, defects, rust, corrosion, weakened materials, or prior damage.
Customers are solely responsible for disclosing any known mechanical issues, defects, modifications, prior treatments, or safety concerns before service begins.
Personal Items
New Frank Auto Restoration LLC is not responsible for personal items left inside or on the vehicle. Customers are responsible for removing all valuables prior to service.
Authorization to Perform Services
By scheduling and approving services verbally, electronically, or in writing, customers authorize New Frank Auto Restoration LLC, its employees, contractors, or agents to perform the agreed-upon services and acknowledge responsibility for all associated charges.
Estimates, Booking, and Payment
Pricing is based on information provided by the customer and any visual inspection performed where applicable. All prices, quotes, or estimates provided via chat, text message, email, phone call, social media, or other communication channels are estimates only and may change if the vehicle’s actual condition differs from what was disclosed or reasonably observable.
To schedule and secure an appointment, a down payment is required. The down payment amount will be communicated after the initial vehicle inspection. Appointments are not confirmed until the down payment has been received.
The remaining balance is due in full upon completion of the service and at the time the vehicle is released or picked up, unless otherwise agreed in writing. No vehicle will be released until full payment has been received.
If additional work, materials, or services become necessary during the service, the customer will be informed in advance. Any additional charges will only be applied after customer approval, which may be provided verbally, by phone call, or via text message. Verbal or electronic approval constitutes authorization to proceed and acceptance of the associated charges.
Cancellations
Cancellations or rescheduling require at least two (2) business days’ notice.
Appearance, Results, and Variability
Undercoating and rust protection services are protective and preventative in nature. Results may vary depending on vehicle age, prior treatments, existing rust or corrosion, materials used, and environmental exposure. No specific outcome, level of protection, appearance, or lifespan is guaranteed.
Care and Post-Service Considerations
Customers agree to follow all reasonable post-service instructions provided. New Frank Auto Restoration LLC is not responsible for damage, performance issues, or deterioration resulting from misuse, alterations, improper maintenance, or failure to follow post-service guidance.
Warranties
Any manufacturer or product warranties are provided solely by the product manufacturer according to their written terms and conditions. Such warranties generally exclude damage caused by misuse, neglect, impact, abrasion, environmental exposure, prior rust or corrosion, or pre-existing vehicle conditions.
Limitation of Liability
To the maximum extent permitted by law, the total liability of New Frank Auto Restoration LLC for any claim arising from services provided shall be limited to three (3) times the cost of the service, capped at five thousand dollars ($5,000) per visit.
New Frank Auto Restoration LLC is not liable for indirect, incidental, special, or consequential damages, including loss of use or diminished value.
Insurance and Responsibility
Customers agree that their personal auto insurance coverage shall be primary for any covered loss related to services provided by New Frank Auto Restoration LLC. Any insurance maintained by New Frank Auto Restoration LLC shall be secondary and non-contributory.
Hold Harmless and Responsibility
To the fullest extent permitted by law, customers agree to indemnify, defend, and hold harmless New Frank Auto Restoration LLC, its owners, employees, contractors, and agents from any claims, losses, damages, or expenses arising out of the services provided, including but not limited to access conditions, disclosed or undisclosed vehicle conditions, customer-approved services or materials, or failure to follow post-service instructions.
This provision does not apply to losses caused by gross negligence or willful misconduct.
Waiver of Subrogation
To the extent permitted by law, customers agree that their insurer waives any right of recovery or subrogation against New Frank Auto Restoration LLC for losses or damages covered by insurance.
Right to Refuse Service
New Frank Auto Restoration LLC reserves the right to refuse or discontinue service if conditions are unsafe, inaccessible, illegal, inappropriate, or materially different from those disclosed at the time of booking.
Entire Agreement and Modifications
These Terms and Conditions constitute the entire agreement between the customer and New Frank Auto Restoration LLC regarding the services provided. Terms may be updated from time to time and will become effective when posted on the website. Continued use of services constitutes acceptance of any revisions.
By scheduling an appointment or receiving services, you acknowledge that you have read, understand, and agree to these Terms and Conditions.
Assumption of Risk
Customers acknowledge that undercoating, rust removal, and restoration services involve inherent risks due to vehicle age, corrosion, prior repairs, and hidden or inaccessible conditions. By authorizing service, customers voluntarily assume all such risks, except those resulting from gross negligence or willful misconduct.
No Mechanical or Structural Warranty
New Frank Auto Restoration LLC does not diagnose, repair, or guarantee mechanical, electrical, suspension, brake, exhaust, or structural integrity issues unless expressly agreed in writing. Services are cosmetic, protective, or preventive in nature only.
Documentation
Customers authorize New Frank Auto Restoration LLC to photograph or video the vehicle before, during, and after service for documentation, quality control, dispute resolution, and internal records. Images may also be used for marketing purposes unless the customer objects in writing prior to service.
Payment Disputes and Chargebacks
Customers agree not to initiate chargebacks or payment disputes for services rendered and approved. Any concerns must be addressed directly with New Frank Auto Restoration LLC before pursuing third-party payment remedies.
Odors and Environmental Effects
Customers acknowledge that undercoating materials may produce temporary odors, residue, dripping, or appearance changes. These effects are normal and do not constitute damage or defect.
Severability
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law and Venue
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York. Any dispute arising from these services shall be resolved exclusively in the courts located within New York City, New York.
